INTRODUCTION

These General Terms and Conditions of Sale exclusively govern the contractual relationship between SAS LA COPHENA NEGOCE ET CONSULTING, distributor of the YATAMANI brand, and any person consulting the Yatamani site or wishing to purchase a product offered on it.

They apply to the exclusion of all other conditions, particularly those applicable to in-store sales.

By browsing the site or confirming an order, the Customer acknowledges having read these General Terms and Conditions of Sale and accepts them without reservation.

These General Terms and Conditions of Sale are accessible at any time on the Yatamani merchant website.

The Company reserves the right to modify these General Terms and Conditions of Sale at any time. The applicable conditions are those in force on the date of the order.

1. PRICES

Product offers are valid in Metropolitan France, Corsica, Monaco, as well as in the countries offered for delivery.

Prices are indicated in euros, all taxes included (TTC), at the VAT rate applicable on the day of the order.

Delivery costs are not included in the displayed prices. Any additional costs are indicated before the final confirmation of the order.

Yatamani reserves the right to modify its prices at any time. Products are invoiced based on the rate in force at the time of order confirmation.

Promotional offers are valid within the limits of their duration and available stock.

In the event of an order from a country other than Metropolitan France, the Customer is considered the importer of the products concerned.

For all shipments outside the European Union and French Overseas Departments and Territories, the price is automatically calculated exclusive of taxes. Customs duties or local taxes may be payable. These costs are the sole responsibility of the Customer.

2. ORDER

Any order implies full and unreserved acceptance of these General Terms and Conditions of Sale.

The Customer declares to have the legal capacity to contract.

The contract is formed when the Customer confirms their order after having checked its details and total price, and after having had the opportunity to correct any errors.

Confirmation of the order constitutes acceptance of the prices, descriptions, volumes and quantities of the products.

The data recorded by Yatamani constitute proof of the transactions carried out.

The concluded contracts are archived for a period of ten (10) years and can be communicated upon request to the following address: contact@lacophena.fr.

3. PAYMENT

Payment is due immediately upon order.

Payment is made by credit card via the secure Stripe platform or by PayPal.

The Customer guarantees that they have the necessary authorizations to use the chosen payment method.

Yatamani reserves the right to suspend or cancel any order in case of non-payment or payment incident.

The products remain the property of SAS LA COPHENA NEGOCE ET CONSULTING until full payment of the price.

4. PRODUCT SELECTION

The Customer chooses the products under their sole responsibility, according to their needs.

It is their responsibility to check the compatibility of the ordered products with those they use.

5. DELIVERY TIMES

Preparation times are one (1) business day, to which is added an indicative Colissimo shipping time of 72 hours.

In accordance with the Consumer Code, products are delivered no later than thirty (30) days from the order, subject to full payment.

6. RETENTION OF TITLE

The products remain the property of SAS LA COPHENA NEGOCE ET CONSULTING until full payment of the price.

7. LIABILITY

The products offered comply with current European legislation.

Yatamani cannot be held responsible for the non-performance of the contract in the event of force majeure, stock shortage, strike or disruption of postal or transport services.

Yatamani's liability cannot be engaged for indirect damages.

8. PARTIAL INVALIDITY

If any provision of these General Terms and Conditions of Sale is declared void, the other provisions remain fully applicable.

9. AVAILABILITY

Products are offered within the limits of available stock.

In the event of unavailability after order, the Customer will be informed as soon as possible and may benefit from a deferred shipment or a refund.

10. DELIVERY

Products are delivered to the address indicated by the Customer when ordering.

In case of incorrect address or non-collection of the parcel, a second shipment will be at the Customer's expense.

Yatamani cannot be held responsible for delays attributable to the carrier.

11. CONFORMITY AND CLAIMS

In case of non-conformity or defect, the Customer has a period of fourteen (14) working days from receipt to make a written complaint.

No returns will be accepted without prior contact with customer service.

Products that have been opened, used or damaged cannot be refunded or exchanged.

12. REFUND

Refunds will be made within a maximum period of thirty (30) days after receipt of the returned products.

The refund will be made by the same payment method used during the order.

No cash-on-delivery shipments will be accepted.

13. NON-WAIVER

The fact that one of the parties does not avail itself of a breach does not constitute a waiver of the right to avail itself of it later.

14. INTELLECTUAL PROPERTY

All elements of the Yatamani site are protected by copyright and intellectual property. Any total or partial reproduction is strictly prohibited.

15. RIGHT OF WITHDRAWAL

In accordance with the Consumer Code, the Customer has a period of fourteen (14) days from receipt to exercise their right of withdrawal.

Return costs are the responsibility of the Customer.

For hygiene and health protection reasons, products unsealed after delivery cannot benefit from the right of withdrawal.
